These Terms of Service (“Terms”) govern your access to and use of holy-scribe.com (the “Website”) and your purchase of products or services from Holy Scribe (“Holy Scribe,” “we,” “us,” or “our”). By visiting our Website, submitting information, placing an order, or purchasing a product, you agree to these Terms. Please read them carefully before using the Website or placing an order. 1. About Holy Scribe Holy Scribe creates personalized biblical keepsakes and other products inspired by biblical names, verses, and the ancient art of the scribe. Many of our products are individually prepared, personalized, and/or hand-inscribed based on information supplied by the customer. Because of the personalized and handmade nature of our work, each piece may have natural and minor variations. 2. Eligibility You must be at least 18 years old, or have the permission of a parent or legal guardian, to make a purchase through our Website. By placing an order, you represent that the information you provide is accurate and that you are authorized to use the payment method submitted. 3. Personalized Orders Many Holy Scribe products are custom-made specifically for the customer. When placing an order, you are responsible for carefully reviewing all information you provide, including: Your name and its spelling; The requested name or wording to be inscribed; Personalization details; Shipping information; and Any other information submitted as part of your order. We may contact you if clarification is necessary before creating your piece. Once production of a personalized item has begun, the order may not be changed or canceled except at our discretion or where required by applicable law. If Holy Scribe makes an error that differs from the information provided or approved by you, we will work with you to correct the issue. 4. Biblical Names, Verses, and Interpretations Holy Scribe provides biblical verses, name meanings, historical information, spiritual reflections, translations, and related content for inspirational, educational, artistic, and cultural purposes. The selection of a verse associated with a person's name may be based on traditions, linguistic connections, the first and last letters of a name, biblical sources, or other interpretive methods used by Holy Scribe. Such selections and explanations should not be understood as a prophecy, guarantee, religious ruling, or definitive statement regarding a person's character, destiny, spiritual status, or future. Translations and transliterations may vary between traditions and editions of biblical texts. 5. Handmade Nature of Our Products Holy Scribe celebrates the individual nature of hand-created work. Handwriting, calligraphy, parchment, framing, positioning, ink, materials, texture, shades, and other details may vary slightly from photographs or examples shown on the Website. These natural variations are not considered defects when they are consistent with the handmade character and quality of the product. Product photographs are intended to provide a reasonable representation of the item. Screen settings, lighting, photography, and natural materials may cause colors or details to appear differently in person. 6. Product Descriptions and Availability We make reasonable efforts to describe our products accurately. We reserve the right to: Correct errors, inaccuracies, or omissions; Update product descriptions; Change prices; Modify or discontinue products; Limit quantities; and Refuse or cancel an order where reasonably necessary. If we cancel an order after payment has been received, we will refund the applicable amount paid for the canceled item. 7. Prices and Payment Prices are displayed in the currency indicated on the Website and may change without notice. Applicable taxes, shipping charges, customs duties, or other fees may be added where required. By submitting payment information, you authorize us and our payment-processing providers to charge the applicable amount to your selected payment method. We may use third-party payment processors. Holy Scribe does not necessarily receive or store your complete credit-card information. 8. Order Acceptance An order confirmation does not necessarily constitute final acceptance of your order. We reserve the right to decline or cancel an order because of: Product availability; Pricing or description errors; Suspected fraud or unauthorized activity; Problems with payment; Incomplete personalization information; or Other reasonable business or legal considerations. If an order is canceled after you have been charged, the applicable payment will be refunded. 9. Production and Shipping Many Holy Scribe products are individually created after an order is placed. Production times shown on the Website are estimates unless expressly stated otherwise. Shipping and delivery dates are estimates and may be affected by circumstances outside our reasonable control, including carrier delays, customs processing, weather, holidays, security conditions, or international transportation issues. We will comply with applicable laws concerning shipment delays, cancellations, and refunds. Tracking information may be provided when available. Customers are responsible for providing a complete and accurate shipping address. 10. International Orders, Customs, and Duties Holy Scribe may ship products internationally. International shipments may be subject to import duties, VAT, taxes, customs charges, brokerage fees, or other government-imposed fees. Unless expressly stated otherwise at checkout, such charges are the responsibility of the recipient and are not included in the purchase price. Customs procedures may also cause delivery delays that are outside Holy Scribe's control. 11. Returns, Refunds, and Personalized Products Because many Holy Scribe products are personalized and made specifically for the customer, we generally cannot accept returns based solely on a change of mind. However, if your product arrives damaged, defective, or materially different from what you ordered due to an error by Holy Scribe, please contact us promptly. Where appropriate, we may provide a replacement, remake, reshipment, refund, or other reasonable resolution. Our current guarantee provides that if your piece does not arrive in proper condition, we will remake and reship it at no additional cost, subject to reasonable verification of the issue. We may request photographs of damaged or defective merchandise and its packaging so that we can evaluate the problem and, where applicable, make a claim with the shipping carrier. Lost or Misdelivered Packages If tracking indicates that a package has been lost in transit, please contact us so that we can investigate with the carrier. Holy Scribe is not responsible for delivery problems caused by an incorrect or incomplete address supplied by the customer. We will nevertheless make reasonable efforts to assist in resolving delivery problems. If a shipment is returned to us because of an incorrect address, refusal, failed delivery attempt, or unpaid customs charges, additional shipping charges may apply before the order can be resent. 13. Intellectual Property Unless otherwise stated, the Website and its original content—including Holy Scribe's branding, logos, product designs, photographs, graphics, written explanations, stories, layouts, videos, and other creative materials—are owned by or licensed to Holy Scribe and are protected by applicable intellectual-property laws. You may use the Website for personal, non-commercial purposes. You may not, without our prior written permission: Copy or reproduce our original product designs; Republish substantial portions of Website content; Use our photographs or videos commercially; Copy our branding or trademarks; Create confusingly similar products or websites using our protected material; Scrape or systematically extract Website content; or Use our original material in a way that falsely suggests affiliation with or endorsement by Holy Scribe. Biblical texts and other public-domain materials remain subject to their respective legal status and are not claimed by Holy Scribe merely because they appear on our Website. 14. Customer-Submitted Content If you submit a name, photograph, testimonial, review, message, personalization request, or other information to us, you represent that you have the right to provide it. Information supplied solely to create a personalized order will be used in accordance with our Privacy Policy. We will not claim ownership of your personal name or personal information simply because you submit it to us. If you voluntarily submit a review, testimonial, photograph, or other content for publication or marketing purposes, you grant Holy Scribe permission to use that material for the purposes reasonably associated with your submission, subject to applicable law and any agreement made with you. 15. Prohibited Uses You may not use the Website: For unlawful or fraudulent purposes; To interfere with Website security or operation; To introduce malware, viruses, or harmful code; To impersonate another person; To attempt unauthorized access to systems or accounts; To collect information about other users without authorization; To infringe intellectual-property rights; or To use automated systems to abuse, overload, or improperly extract data from the Website. We may restrict access to the Website when we reasonably believe these Terms have been violated. 16. Third-Party Services and Links Our Website may use or link to third-party services, including payment processors, shipping companies, social-media platforms, analytics providers, or other websites. Those third parties operate under their own terms and privacy policies. Holy Scribe is not responsible for the content, security, availability, or practices of independent third-party websites or services. 17. Website Availability We work to keep the Website operating reliably but cannot guarantee uninterrupted or error-free access. We may temporarily suspend, modify, update, or discontinue portions of the Website for maintenance, security, business, or technical reasons. 18. Disclaimer of Warranties To the fullest extent permitted by law, the Website and its content are provided on an “as available” basis. Except for warranties or guarantees expressly stated by Holy Scribe or required by law, we disclaim implied warranties to the maximum extent permitted by applicable law. Nothing in this section excludes warranties or consumer protections that cannot legally be excluded. 19. Limitation of Liability To the fullest extent permitted by applicable law, Holy Scribe will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Website or purchase of our products. Where permitted by law, Holy Scribe's aggregate liability arising from a particular purchase will not exceed the amount actually paid to Holy Scribe for the product giving rise to the claim. These limitations do not apply where prohibited by applicable law. 20. Indemnification To the extent permitted by law, you agree to indemnify and hold harmless Holy Scribe and its owners, employees, contractors, agents, and service providers from claims, losses, liabilities, and reasonable expenses resulting from your unlawful misuse of the Website, your violation of these Terms, or your infringement of another person's rights. 21. Force Majeure Holy Scribe will not be responsible for a failure or delay caused by circumstances reasonably outside our control, including natural disasters, war, terrorism, civil disturbances, government actions, transportation interruptions, customs delays, labor disruptions, internet or utility failures, epidemics, or major carrier disruptions. This provision does not remove any refund, cancellation, or other rights that applicable consumer law gives you. 22. Governing Law These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Subject to any rights that applicable law gives consumers to bring proceedings elsewhere, disputes relating to these Terms or purchases from Holy Scribe will be brought in an appropriate state or federal court located in New Jersey. 23. Severability If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. 24. No Waiver If Holy Scribe does not immediately enforce a provision of these Terms, that does not constitute a waiver of our right to enforce it later. 25. Changes to These Terms We may update these Terms periodically to reflect changes to our Website, products, practices, or applicable law. The revised Terms will be posted on this page with an updated effective date. Changes will apply prospectively unless otherwise required by law. 26.
